These Terms of Service (“Terms”) govern your access to and use of the websites, products, and services provided by Home Decor AI (“Home Decor AI,” “we,” “us,” or “our”), including homedecor.io (collectively, the “Service”). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 18 years old, or the age of legal majority in your jurisdiction, to use the Service. By using the Service, you represent that you meet this requirement and that you have the authority to enter into these Terms. If you use the Service on behalf of an organization, you represent that you are authorized to bind that organization to these Terms.
2. The Service
Home Decor AI is an AI interior design tool. You upload photographs of rooms and other spaces, and the Service generates redesigned, photorealistic images in a range of styles. Generated results are produced by automated systems and are intended for inspiration and visualization. They are not architectural, structural, engineering, or professional design advice, and they do not guarantee that a depicted result is achievable, safe, or accurate.
3. Accounts
To use most features you must create an account. You agree to provide accurate information, to keep it up to date, and to keep your credentials confidential. You are responsible for all activity that occurs under your account. Notify us promptly at contact@homedecor.ioif you suspect unauthorized use. You may sign in using email and password or through a supported third-party provider such as Google, subject to that provider’s terms.
4. Subscriptions, Billing, and Refunds
- Plans and fees. Some features require a paid plan. Prices, credits, and plan features are described at the point of purchase and may change over time.
- Billing. Paid plans are billed in advance on a recurring basis (for example, monthly or annually) through our third-party payment processor. By subscribing, you authorize us to charge your payment method on each renewal until you cancel.
- Cancellation. You may cancel at any time from your account settings. Cancellation stops future renewals. Unless required by law, access continues until the end of the current billing period.
- Refunds. Except where required by law, payments are non-refundable and we do not provide refunds or credits for partial periods or unused credits.
- Taxes. Fees are exclusive of taxes, which you are responsible for where applicable.
5. Your Content and License to Us
“Your Content” means the images and other materials you upload to the Service. You retain all ownership rights in Your Content. You grant Home Decor AI a worldwide, non-exclusive, royalty-free license to host, store, reproduce, modify, process, and create derivative works from Your Content solely for the purpose of operating, providing, securing, and improving the Service and generating results for you.
You represent and warrant that:
- You own Your Content or have all rights and permissions necessary to upload it and grant the license above.
- Your Content does not infringe the intellectual property, privacy, publicity, or other rights of any person.
- You will not upload images of individuals without their consent where such consent is required, and you will not upload content you are not authorized to use.
6. AI-Generated Results
Subject to your compliance with these Terms and applicable law, as between you and Home Decor AI, you own the design results generated from Your Content. Because the Service uses generative models, results may be similar to those produced for other users, and we make no guarantee that any result is unique. Results may contain inaccuracies or artifacts and should not be relied upon as a precise representation of a real space, product, or material. You are responsible for how you use generated results.
7. Acceptable Use
You agree not to use the Service to:
- Violate any law or the rights of others.
- Upload content that is unlawful, infringing, defamatory, obscene, or that depicts a person without required consent.
- Create sexually explicit, hateful, harassing, or deceptive content, or content that facilitates harm.
- Attempt to reverse engineer, decompile, or extract the underlying models or source code, except to the extent permitted by law.
- Interfere with, disrupt, or overload the Service, or circumvent usage limits, security, or authentication measures.
- Use automated means to access the Service in a manner that exceeds reasonable use or violates these Terms.
- Resell or sublicense the Service without our prior written permission.
8. Intellectual Property
The Service, including its software, design, text, graphics, and trademarks, is owned by Home Decor AI or its licensors and is protected by intellectual property laws. Except for the rights expressly granted to you in these Terms, we reserve all rights. You may not use our name, logos, or branding without our prior written permission.
9. Third-Party Services
The Service integrates with third-party services, including sign-in providers, payment processors, hosting, and AI model providers. Your use of those services is governed by their own terms and privacy policies. We are not responsible for third-party services, and their availability may affect the Service.
10. Disclaimers
The Service is provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, secure, or that generated results will meet your expectations or be accurate.
The Service references paint colors by the names and codes used by their manufacturers, including Sherwin-Williams, Benjamin Moore, Behr, Valspar, PPG, Dunn-Edwards, and Farrow & Ball. Those names, codes, and associated trademarks are the property of their respective owners. Home Decor AI is not affiliated with, sponsored by, or endorsed by any paint manufacturer. Colors shown on screen are approximations: display calibration, image lighting, and AI rendering all affect how a color appears, and no on-screen preview substitutes for a physical paint sample. Confirm any color choice with the manufacturer’s own swatch or sample before purchasing paint.
11. Limitation of Liability
To the maximum extent permitted by law, Home Decor AI and its officers, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or related to your use of the Service. To the maximum extent permitted by law, our total liability for any claim arising out of or relating to the Service will not exceed the greater of the amount you paid us in the twelve months before the event giving rise to the claim, or one hundred United States dollars (US$100).
12. Indemnification
You agree to indemnify and hold harmless Home Decor AI and its officers, employees, and suppliers from any claims, damages, liabilities, and expenses, including reasonable legal fees, arising out of or related to Your Content, your use of the Service, or your violation of these Terms or applicable law.
13. Termination
You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms, if we are required to do so by law, or if we discontinue the Service. Upon termination, your right to use the Service ends. Sections that by their nature should survive termination, including ownership, disclaimers, limitation of liability, and indemnification, will survive.
14. Changes to the Service and Terms
We may modify or discontinue the Service, in whole or in part, at any time. We may also update these Terms from time to time. When we make material changes, we will update the “Last updated” date above and, where appropriate, notify you. Your continued use of the Service after changes take effect means you accept the revised Terms.
15. Governing Law and Disputes
These Terms are governed by the laws of the jurisdiction in which Home Decor AI is established, without regard to conflict-of-laws principles. You agree that any dispute arising out of or relating to these Terms or the Service will be resolved in the courts located in that jurisdiction, and you consent to their jurisdiction, except where applicable law gives you the right to bring proceedings in your local courts.
